Healthy Roads Media Materials Terms of Use

Healthy Roads Media. ("HRM" or "we") provides the content posted on the healthyroadsmedia.org website and other related websites to you subject to the following Terms of Use. These terms are based on Creative Commons licensing, which allows broad but fair use of HRM resources. When you use the HRM Website and resources, you agree to be bound by these Terms of Use. These Terms of Use incorporate the terms of any subscriber agreement that may exist between you and HRM. To the extent there is a conflict between these Terms of Use and your subscriber agreement, the terms of your subscriber agreement will control your use of the HRM Website. Please read these Terms of Use carefully. If you do not agree with these Terms of Use, please do not use the HRM Website.

The HRM Website

The HRM Website, including the text, graphics, and software that appear on the HRM Website, is owned by or licensed to HRM, and is subject to copyright and other intellectual property rights under United States, foreign laws and international conventions.

Users may not re-post HRM's content on other web sites without the permission of HRM. User cannot re-sell any of HRM's content to third parties, or prepare derivative works of HRM's content without specific written permission of HRM.

HRM Content

The HRM Website is designed to offer users general health information for educational purposes only. Every effort is made to ensure that this information is accurate, however, the general health information furnished on this site is not intended to replace personal consultation with a qualified health care professional. You must always seek the advice of a professional for questions related to you disease, disease symptoms, and appropriate therapeutic treatments. HRM does not give medical advice, or provide medical or diagnostic services. Permission to reproduce HRM material

Permission to reproduce any material from the HRM service in another publication or web site must be secured in writing.

Allowed Uses

HRM encourages its users to print topic handouts for personal, clinical, educational, or research use. The audio files, multimedia files and iPod video files may also be downloaded for personal, educational or research use. All of these materials must be given free of charge and all attributions must remain intact. Users may email individual topic handouts, including patients and colleagues as permitted by the website's functionality. Users may also link to www.healthyroadsmedia.org, and/or specific HRM topics.

After purchase, the license for HRM instant download MPEG2 videos, allows you to use these videos in your EHR System, your institution's intranet, loaded onto display devices used within your organization (laptops, tablets or iPads, etc.), and used in your institution’s Closed-Circuit Television and Video-on-Demand System. You may convert your purchased HRM instant download MPEG2 videos to a different format, if required for use in your CCTV/VOD system.

Restrictions

Use of the HRM instant download MPEG2 videos is absolutely restricted to within your institution and so cannot be streamed via the internet or broadcast outside your institution without specific permission from Healthy Roads Media. Contact Healthy Roads Media if you are interested in using these instant download videos for this or any other any other purpose not specifically permitted in the terms of use.

The HRM instant download MPEG2 videos may not used to create any derivative materials.

We reserve the right to limit or suspend your use of the HRM Website, by electronic self-help or other means and without notice, if we believe you have committed a breach of security or violated these Terms of Use, subject only to any terms in your subscriber agreement, as applicable.

HRM reserves all of its rights in the HRM Website not expressly granted to you by these Terms of Use.

No Unlawful Use

You agree not to use the HRM Website for any purpose that is unlawful or prohibited by these terms, or the terms of a subscriber agreement you have with HRM, if applicable. You may not use the HRM Website in any manner that could damage, disable, overburden, or impair any HRM server, or the network(s) connected to any HRM server, or interfere with any other party's use and enjoyment of the HRM Website. You may not attempt to gain unauthorized access to any portion of the HRM Website, other accounts, computer systems, or networks connected to any HRM server, through hacking, password or data mining, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available to you on the HRM Website.

No Warranties

NEITHER HRM, NOR ANY PARENT, SUBSIDIARY, AFFILIATE, DIRECTOR, EMPLOYEE, LICENSOR, LICENSEE, DISTRIBUTOR, SUPPLIER, AGENT, OR RESELLER OF HRM (COLLECTIVELY, THE "HRM ENTITIES") MAKE ANY WARRANTY OR REPRESENTATION, EXPRESSED OR IMPLIED, WITH RESPECT TO THE HRM SERVICES, WHICH ARE PROVIDED "AS IS", OR WITH RESPECT TO THESE TERMS OF USE. THE HRM ENTITIES EXPRESSLY EXCLUDE AND DISCLAIM ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USE OF TRADE. ANY STATEMENTS OR REPRESENTATIONS MADE BY ANY OTHER PERSON OR ENTITY ARE VOID. YOU ASSUME ALL RISK AS TO THE QUALITY, FUNCTION, AND PERFORMANCE OF THE HRM WEBSITE.

In addition, please note that the HRM Website may include technical inaccuracies or typographical errors. HRM has the right at any time to change, modify, add to, discontinue, or retire any aspect or feature of the HRM Website, including, but not limited to, hours of availability, equipment needed for access or use, or the availability of the HRM Services on any particular device or communications service. Limitation of Liability

IN NO EVENT WILL THE HRM ENTITIES OR ANY OTHER PARTY WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, DISTRIBUTION, PROMOTION, OR MARKETING OF THE HRM WEBSITE OR THESE TERMS OF USE BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, RELIANCE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA OR PROFITS, OR FOR INABILITY TO USE THE HRM WEBSITE, EVEN IF THE HRM ENTITIES OR SUCH OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to defend, indemnify, and hold harmless the HRM Entities from all liabilities, claims, and expenses, including attorneys' fees, that arise from your use of the HRM Website. HRM reserves the right, at it own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with HRM in asserting any available defenses.

Modifications

HRM may modify these Terms of Use from time to time and changes will be effective upon posting to the HRM Website. You agree to be bound by any modification of these Terms of Use when you use the HRM Website, effective after their posting to the HRM Website. It is therefore important that you review these Terms of Use regularly to ensure you are updated as to any changes.

Claim of Copyright Infringement

HRM respects the intellectual property of others. If you believe that your copyrighted work has been copied and is accessible on the HRM Website in a way that constitutes copyright infringement, pursuant to Title 17, United States Code, Section 512(c)(2), you may send a notification of claimed copyright infringement to HRM's designated agent along with the following information:

  • the electronic or physical signature of the owner of the copyright or the person authorized to act on the owner's behalf
